I work for company A which sponsored my L1B (my current visa status). Also, few years back company B sponsored my H1B which for some reason I did not utilize (did not even get it stamped) and hence company B cancelled it. Now my questions are -
1. Can L1-B be transferred to H1-B without going through a new visa application?
2. Can the cancelled H1-B be re-instated and utilized?
3. If another company C applies for my H1-B what are the chances of getting it looking at the current work visa regulations and prospective changes? Will my past petition of H1-B cause some issues with consulate?
4. My wife is on L2 and as EAD. Once I file for change of status will the EAD still be valid or it will automatically be void?
Please Help...

Hi every1,
I am on H1. I got married earlier this year :), my wife is on OPT which expires early next year. She is currently working for XYZ company which would not extend her OPT. We haven't been able to find a job(H1) for her yet.
Would any of below can cause any problem.
1. I don't have H1 stamping from my home country??
2. Her last name is not changed??

Hi All,
I am in the fourth year of mu H1b, and I need to start my GC process. My current employer is a consulting firm which provides services to a third party main client. My questions are :
a) is this a good time to file for GC given the fact that my company falls under employer-employee relationship memo?
b) I plan to go to India in summer and need to get my stamping. Will the new memo from USCIS affect my stamping? My current h1b expires in sept 2011.
c) If I apply for my GC before going to India in summer, does it affect point b ?
Thanks to anyone who can answer my questions.

My friend just forwarded me this link and it shows 1-jun-2006 priority date for EB2. For EB3 it still shows Unavailable. However US State website still shows old dates.

Very recently our company advertised for a position, this was for one of my co workers from China, company received over 200 resumes, I heard that the new rule is to reply to all the resumes and tell them why they dont qualify etc..

We move and my wife and I did an online AR11 and ONLINE I-485 Mailing address change using USCIS website yesterday.
My wife got an automatic email confirmation that her I-485 Mailing Address is changed and we even see the LUD is changed as well
but I didnot get any email confirmation of the address change of I-485 neither I see any LUD change.
1. What should I do? Call CIS?
2. How long does it take to update Mailing Address on I-485 when changing the mailing address online after Online AR-11 submission?
Please advise

My friend is an F1 student (citizen of India) who has been in the US for 3 years as a grad student. She has paid US taxes on stipend/fellowship received from US university while pursuing grad studies (filing taxes as a non resident in US, since the first 5 years on F1 are not counted towards substantial presence test).
Does she need to also pay taxes on this stipend in india, or report this income in india? AFAIK, no taxes need to be paid in India on this US stipend, but I couldnt find any authoritative reference online.
Am asking, since someone I know recently got a letter from IT dept in india saying that the US authorities reported $10K of income when that person was a student (this was a fellowship from the university) - and the letter goes on to ask the person to meet someone at the indian IT department.
